By this Original Application, the applicant is seeking the following relief:
“This Hon'ble Tribunal may be pleased to declare the inaction of the respondents in the matter of placing the applicant in the upgraded pay scale of Rs.5500-9000 in 5th CPC w.e.f. 01.01.1996 as illegal; and direct the respondents to fix the pay of the applicant in the pay scale of Rs.5500-9000 in 5th CPC w.e.f. 01.01.1996 in the post of Senior Chargeman and accordingly pay the arrears pertaining to the difference in pay between the pay already drawn in the pay scale of Rs.5000-8000 and the pay scale of Rs.5500-9000 to be offered by granting all other consequential benefits which includes the arrears of pay in respect of the consequential revision of pay from time to time with all other consequential benefits and to pass such other order or orders in the interest of justice.”

The brief facts of the case, as stated by the applicant, are that he was appointed in the Eastern Naval Command, Visakhapatnam to the grade of Senior Chargeman on 03.07.1995 and presently working as Technical Assistant (Construction). He was placed in the pay scale of Rs.1400-2300 in 4th CPC pay scale at the time of his initial appointment. The Senior Chargeman post was re-designated as Chargeman-II in the 5th CPC scenario with pay scale of Rs.5000-8000. The 1st respondent, though extended the pay scale of Rs.5500-9000 to the Senior Chargeman working in Naval Armament Stores Organization (NASO) w.e.f. 01.01.1996 as per 5th CPC recommendations, however, did not extend the said benefit to the counterparts working in Naval Dockyards and Naval Armament Inspection Organization (NAIO). As a result, Senior Chargemen working in the Naval Dockyards and NAIO remained in the pay scale of Rs.5000-8000. However, when the Senior Chargeman working in NASO, who were granted the higher pay scale faced a situation of downgrading their pay scale from Rs. 5500-9000 to Rs. 5000-8000, they approached different Benches of this Tribunal and after those cases attained finality, the said Senior Chargeman working in NASO got their pay scale restored to Rs.5500-9000 w.e.f. 01.01.1996. Certain Technical Staff working in Naval Ship Repair Yard, Kochi approached the Co-ordinate Bench, Ernakulam for the said benefit and filed O.A.
