By this Original Application, the applicant is seeking the following relief:

“This Hon'ble Tribunal may be pleased to call for the records pertaining to letter No.SCR/P-SC/297/LR6/Asst. Loco Pilots/2015, dated 04.10.2016 and quash and set aside the said letter by declaring that the action of the respondents in not fixing the seniority of the applicant correctly after his relief from Vijayawada division to Secunderabad division on the basis of an order of mutual transfer as illegal, arbitrary, unjust, discriminatory and direct the respondents to fix the seniority of the applicant as was shown in the reply given 11.02.2014 to the grievance raised by the applicant i.e., placing his name in the seniority list circulated vide letter dated 20.09.2013 below A. Venkata Ramana appearing at SI.No.308 and revise the seniority of the applicant which is wrongly shown at Sl.No.375 as on 31.08.2015 circulated vide letter dated 30.09.2015, by upgrading it as mentioned in the above said reply dated 11.02.2014 by allowing all consequential benefits including revising the promotion order dated 30.11.2015 as Sr.ALP, duly granting all benefits including promotions, pay fixations and arrears there of etc., on par with the juniors to the applicant and pass such other order or orders as deemed fit and proper in the facts and circumstances of the case and in the interest of justice.”

2. The brief facts of the case, as stated by the applicant, are that he, on mutual transfer, from Vijayawada division joined Secunderabad division during February, 2013. Even though, he applied for mutual transfer while working as Senior Assistant Loco Pilot, the Secunderabad division authorities considered as if the applicant was reverted from Senior Assistant Loco Pilot post to Assistant Loco Pilot and accordingly, fixed his seniority in the ALP cadre. The applicant submitted representation dated 14.10.2015 to fix his seniority correctly, which was considered and corrected in terms of a reply dated 11.02.2014 to the grievance raised by the applicant. By virtue of this correction carried out, it is clear that the status of the applicant as Sr. ALP, which was the position as on the date of his relief from Vijayawada division, has been restored and considering this, the applicant also has been directed to undergo mandatory training for promotion to the post of Loco Pilot (Goods).
