Applicant is aggrieved by Annexure-A5 order passed by the Administrative Officer-II, the 4th respondent on behalf of the 2nd respondent, on 13.04.2021 whereunder he was informed that a sum of Rs.2,46,279/- will be recovered from the retirement gratuity; that was done. Aggrieved by the same, the applicant has approached the Tribunal for setting aside Annexure- A5, for declaring that such an amount after more than a decade of grant and disbursal of 2nd and 3rd MACP scheme benefits to the applicant, who is a Group-C retired employee, is bad in law and contrary to the ratio of the decision of the Hon'ble Apex Court in State of Punjab and others v. Rafiq Masih [(2015) 4 SCC 334], to issue necessary directions to return that amount with interest from 31.05.2021, the date of his retirement and such other reliefs.
