Applicant is aggrieved by Annexure-A5 order passed by the Administrative Officer-II, the 4^th respondent on behalf of the 2^nd respondent, on 13.04.2021 whereunder he was informed that a sum of Rs.2,46,279/- will be recovered from the retirement gratuity; that was done. Aggrieved by the same, the applicant has approached the Tribunal for setting aside Annexure- A5, for declaring that such an amount after more than a decade of grant and disbursal of 2^nd and 3^rd MACP scheme benefits to the applicant, who is a Group-C retired employee, is bad in law and contrary to the ratio of the decision of the Hon'ble Apex Court in State of Punjab and others v. Rafiq Masih [(2015) 4 SCC 334], to issue necessary directions to return that amount with interest from 31.05.2021, the date of his retirement and such other reliefs.

2. The official profile of the applicant is not in dispute. According to the applicant, he has started career as Electrician Skilled in the Base Repair Organisation, Kochi, (now re-designated as Naval Ship Repair Yard), on 08.04.1986.
