The present O.A has been filed by the applicant under section

19 of the Administrative Tribunal Act, 1985 seeking following

reliefs:-

“(i) To set aside the impugned termination order dated 28.06.2016 issued by respondent No.3 (Annexure No. A-1 with compilation No.1) and reinstate to applicant in service with all consequential benefits.

(i)-a To quash and set aside the impugned appellate order dated

23.02.2017 passed by respondent No. 2 (Annexure No. 1-A-1 with compilation No.1) and reinstate to applicant with all consequential benefits.

(ii) To issue a mandamus directing to respondent No.2 to decided the appeal dated 11.8.2016 of applicant within a stipulated period.

(iii) To issue any other direction or order as this Hon’ble Tribunal may deem fit and proper in the circumstances of the applicant.

(iv) To award costs throughout to the applicant”.

2. The brief facts of the OA are as follows:-

The applicant was duly selected and appointed to the post of Civilian Group ‘C’ (Word Sahayika) pursuant to a notification published in Employment News dated 30.06.2012 to 06.07.2012. She was appointed vide appointment letter dated 06.11.2012 issued by respondent No. 3 and joined her duties on 31.10.2012 on probation. While discharging her duties, the applicant was subjected to a serious incident on 17.06.2015, wherein she was badly abused and assaulted resulting in her falling unconscious. She was initially given first aid at the hospital where she was working, but thereafter was turned out on the ground that she was a civilian employee. Subsequently, she was admitted as an emergency patient in Civil Hospital and remained hospitalized from 17.06.2015 to 27.06.2015. The doctors advised bed rest and later issued a medical fitness certificate permitting her to resume duties. After the said incident, the applicant suffered from severe mental trauma and was diagnosed with reactive depression and mixed anxiety disorder by doctors of the Air Force Hospital as well as Civil Hospital. Despite her medical condition, the respondents, under the influence of officers involved

SRIVASTAVA in the incident, attempted to dilute the seriousness of the matter by

falsely describing it as a case of insect bite. The applicant’s father

made a written complaint dated 22.07.2015 to respondent No. 3,

seeking an enquiry into the incident. However, no proper enquiry

was conducted and the complaint was ignored. Instead, the applicant was repeatedly harassed by issuance of notices and warning letters, despite her submitting detailed replies explaining her condition and denying the allegations. Due to the continuous harassment and the earlier incident, the applicant again suffered from reactive depression in September 2015 and was medically examined at a mental health care centre in Lucknow.
