CENTRAL ADMINISTRATIVE TRIBUNAL
Rajinder Singh Dogra, Judicial Member, Ram Mohan Johri, Administrative Member
Neetu Rani Najawan – Appellant
Versus
Union Territory of J&K through Commissioner Secretary, Technical Education – Respondent
Original Application No. 1330/2023
For the Appellants/Petitioners: Mr. Amit Gupta
For the Respondents: Mr. Rajesh Thapa, Ld. AAG
Long-term contractual workers on essential duties entitled to regularization, salary parity, and arrears despite scheme origins, per equity and Art.14.
Headnote:The applicant, engaged as computer instructor and later hostel warden under various schemes since 2001, claimed regularization under J&K Civil Services (Special Provisions) Act, 2010 after completing seven years of service, salary enhancement to match peers paid from treasury, release of withheld salary, and related reliefs. Court found rejection of regularization vide letter dated 29/09/2016 arbitrary, non-speaking, and violative of Article 14, noting continuous service, prior recommendations, and unimplemented High Court directions in SWP 1565/2013 under J&K Technical Education (Subordinate Services) Recruitment Rules, 2022. Disparity in pay and funding sources offended equal pay principles under Article 39(d). Key issues framed: entitlement to regularization despite scheme-based engagement, applicability of 2010 Act post-repeal, salary parity with similarly situated incumbents, and justification for withholding salary during Covid-19. Ratio: Prolonged essential service creates legitimate expectation for absorption; mechanical rejection without reasons vitiates natural justice; scheme objections untenable after 20+ years; precedents like State of Karnataka v. Umadevi permit equity for long-term workers; recent Supreme Court in Jaggo v. Union of India mandates regularization against exploitation via temporary labels. Original Application allowed; rejection letter quashed; regularization directed w.e.f. 2013 on notional basis with arrears, salary enhancement from treasury, withheld salary release, NIC inclusion, and no replacement till regularization, within 12 weeks.
