The applicant has approached this Tribunal under Section 19 of the Administrative Tribunal Act, 1985 praying for the following relief(s):

“(a) An order quashing and/or setting aside the impugned Seniority List dated 17.03.2023, the enclosure to the letter dated 11.09.2023 and impugned letter dated

25.09.2023.

(b) An order directing the respondents to fix the Seniority of the applicant in the Provisional Combined Seniority List of CDMS in Level-7 as on 01.01.2023 taking into account the date of appointment of the applicant as SSE (Printing Press) on 19.01.2018 and to revise the enclosure to the letter dated 11.09.2023 on the basis of such Revised Seniority List and directing the official respondents to grant Level-8 on the basis of such Revised Seniority List with all consequential benefits.

(c) An order directing the respondent authorities to produce/cause production of all the relevant records.

(d) Any other order or further order/orders as to this Hon'ble Tribunal may seem fit and proper.”

2. Facts of the case:

2.1 The applicant is posted as Chief Depot Material Superintendent (CDMS), N.F. Railway at New Jalpaiguri under Katihar Division. The name of the applicant figures at Sl. No. 48 of the Provisional Combined Seniority list of CDMS in Level-7 issued on behalf of General Manager(P), North East Frontier Railway, vide order dated 17.3.23 (Annexure A-3). In the said provisional seniority list, the date of appointment of the applicant is shown as 30.4.2019. The applicant had submitted a representation against the said seniority list, vide his letter dated 09.08.24 addressed to the General Manager (P), North East Frontier Railway, Maligaon, Guwahati. The applicant is also aggrieved with the list of CDMS (Level-7) of Store Department issued vide communication dated 11.09.2023 on behalf of the General Manager (P), N.F. Railway, Maligaon, Guwahati where his name figures at Sl. No. 50 and where his date of appointment shown as 30.04.19.

2.2 The applicant had submitted a representation, vide letter dated 29.09.2023 addressed to the General Manager (P), N.F. Railway, Maligaon wherein he had sought correction in the date of his appointment as mentioned in the provisional seniority list dated 11.09.2023. The representation of the applicant was forwarded by the Dy. CMM, New Jalpaiguri to the GM (P), N.F. Railway, Maligaon, vide letter dated 15.9.2023 (Annexure A-5). However, vide letter dated 25.09.2023 (Annexure A-6) issued on behalf of General Manager (P), Maligaon the Dy. CMM, New Jalpaiguri was informed that the effective date of seniority of the applicant is 30.4.2
