ORAL ORDER

(As per Hon’ble Dr. Lata Baswaraj Patne, Judicial Member) By this Original Application, the applicant sought the following relief:

“This Hon'ble Tribunal may be pleased to call for the records pertaining to the 4" respondent Lr.No.BI/PM-MG/2011 & 2012 dated 21.08.2018 refusing to grant seniority to the applicant on par with others who are selected to the post of Postman along with applicant under Direct Recruitment Quota vide their orders dated 16.11.2014 on the illegal ground that the applicant is not eligible for such seniority on par with the other four (4) candidates for the reason that the has not physically worked and quash and set aside the same as illegal, arbitrary and violative of Article 14 and 16 of the Constitution of India and rules on the subject matter and consequently declare that the applicant is entitled for counting of his seniority from 26.03.2015 on par with the other four candidates selected along with the applicant with all consequential benefits in the interest of justice and be pleased to pass such other order or orders as this Hon'ble Court deem fit and proper in the circumstances of the case.”

The brief facts of the case are that the applicant is challenging the 4th respondent Letter dated 21.08.2018 refusing to grant seniority to the applicant on par with others who are selected to the post of Postman along with applicant under Direct Recruitment Quota vide their orders dated 16.11.2014 on the illegal ground that the applicant is not eligible for such seniority on par with the other four (4) candidates for the reason that the has not physically worked, as the same is illegal, arbitrary and violative of Article 14 and 16 of the Constitution of India and rules on the subject matter. The very appointment and training of the applicant was delayed only on the ground of pending criminal proceedings and when the very basis of the same has gone, the respondents cannot anymore rely upon the same to deny the right of appointment and training to the applicant and seniority on par with the other candidates who are selected along with the applicant from 26.03.2015. The respondents rejected the representation of the applicant through the impugned order dated 21.08.2018 does not stand the scrutiny of law. Being aggrieved the applicant filed the present O.A.
