1. The SWP/WP(C) No. 1439/2017 was transferred from the Hon’ble High Court of Jammu and Kashmir at Jammu and was registered as T.A. No. 61/173/2025 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court with following prayer:

a) “allow the present amended writ petition;

b) quash Notice No. DIP/J-801 dated 08.05.2017, to the extent, under the name of the petitioner in the said Notice, the words "recommendation withheld" have been inserted;

c) quash the words "recommendation withheld" mentioned under the name of the petitioner in Notice No. DIP/J-801 dated 08.05.2017, direction further with to appointment the petitioner as Teacher District Cadre, Jammu pursuant to Notice No. 05 of

2013 (Item No. 478);

d) direct the respondents to delete the words "recommendation withheld" from under the name of the petitioner in the notice No. DIP/J-801 dated 08.05.2017; with further direction to appointment the petitioner as Teacher District Cadre, Jammu pursuant to Notice No. 05 of 2013 (Item No. 487) w.e.f the date, appointment orders are issued in favour of the other candidates figuring in notice dated 08.05.2017;

e) quash office order no. 192-SSB of 2020 dated 2.07.2020 passed by respondent no. 2 whereby and whereunder the claim of the petitioner for selection and consequent appointment for the post of teacher District Cadre, Jammu pursuant to advertisement Notice No. 05 of 2013 has been rejected;

f) ANY other writ, order or direction which this Hon'ble Court may deem fit or proper in the facts and circumstances of the case.”

3. The facts of the case as averred by the petitioner in her pleadings are as follows:

a) The petitioner, Ranjna Charak, applied for the post of Teacher in District Cadre, Jammu under the Open Merit category pursuant to Advertisement Notification No. 05 of 2013. At the time of application, she was already in possession of Graduation, B.Ed., and Post-Graduation degrees from the University of Jammu.

b) However, while filling the OMR application form, the petitioner inadvertently omitted to reflect her B.Ed. qualification in the designated field, despite having acquired the degree well before the cutoff date for submission of applications. This omission, though bonafide, led to non-award of marks for the B.Ed. qualification in the initial evaluation.

c) During the course of interview, the petitioner submitted her B.Ed. degree and explained the inadvertent omission. Taking cognizance of the explanation and the genuineness of the document submitted, the officials of the Jammu and Kashmir Services Selection Board (JKSSRB) recorded the qualification and awarded the due marks. As a result, the petitioner secured 61.073 marks and was placed at Serial No. 46 in the waiting list for the OM category.

d) Subsequently, vide Notice No. CEOJ/23705-07 dated

04.09.2016, published in the Daily Excelsior, candidates were directed to appear for verification of documents. Based on verification and recommendations in the 123rd meeting of the JKSSRB, certain candidates’ selection was cancelled, and a revised list of 18 candidates was notified vide Order No. 1364-

SSB-2016 dated 16.11.2016.
