1. In the instant OA, it is the grievance of the applicant that his representation for upgrading the benchmark from “Average” to “Good” in ACRs for the year 2007-08 and 2008-09, has not been considered in its true spirit and his name has been erroneously not recommended by the Screening Committee held on 20.09.2010 for grant of benefit under MACP –III (Annexure A/1). Therefore, the applicant being aggrieved with the decision of the Screening Committee dated 20.09.2011 as well as the rejection of his representation vide order dated 22.10.2010 (Annexure A/2), passed by Assistant Director Postal Services (STA), Gujarat Circle, Ahmedabad, order dated 03.06.2011 (Annexure A/3) whereby the Postmaster General, Rajkot Region, considered the representation of the applicant 26.03.2011 and informed him that his CRs for the period from 2005-06 and 2006 -07 has been ordered to be read as “Good” in place of “Average” and further informed him that in the remaining period i.e., from 07.11.2007 to 09.03.2008, there is no change in the grading, further, being aggrieved with the order dated 26.09.2011 (Annexure A/4), passed by the Postmaster General, Rajkot Region, Rajkot, whereby his representation dated 21.05.2011 against below benchmark grading in APAR for the period from 01.04.2008 to 21.12.2008 & 22.12.2008 to 31.03.2009 has been rejected and also being aggrieved with the letter /communication dated 13.01.2012 issued by the O/o CPMG whereby he was conveyed that the Screening Committee has once again reviewed his case due to his unsatisfactory service record (below bench mark) the official was not recommended for MACP-III and it has been decided that he may be given one more chance for representing to the Competent Authority for upgrading the bench mark from “Average” to “Good” for the year 2007-08 and 2008-09 (Annexure A/5), has filed the present OA, under section 19 of the Administrative Tribunal Act, seeking relief to quash and set aside the said order/communication of the respondents (Annexure A/1 to A/5) and prayed for issuance of direction upon the respondents to consider his ACRs for the year 2003-04, 2004-05, 2005-06, 2006-07 and 2007-08 for grant of MACP-III to him w.e.f. 01.09.2008 and further direct the respondents to discard adverse remarks recorded in ACRs for the year 2007-08 and to consider his representation for upgradation to appropriate benchmark “Good” required for grant of 3 ^rd MACP by placing his case before the Competent Authority. Further he sought relief for direction upon the respondents to consider his case for grant of 3^rd MACPs from 01.09.2008 with GP-4800/- with consequential benefit including the revision and re-fixation of his monthly pension and all other benefits in light of his placement in 3^rd MACP with effect from

01.09.2008.
