1. The present Original Application has been filed by the applicants under Section 19 of the Administrative Tribunals Act, 1985 seeking the following relief:-
(i) That impugned orders dated 15.07.2022 (Annexure A-1) and impugned orders dated 24.12.2022/24.02.2023 (Annexure A-2) issued by O/o respondent No.1 rejecting the request of the applicants for protection of may be quashed/set-aside.
(ii) That directions in the nature of mandamus be issued to consider the case of applicants for protection of their pay as drawn by them in their earlier organization (Nationalized Bank) on their appointment on direct recruitment basis in PGIMER as per DOPT OM dated 13.08.2020 (A-9) and OM dated 14.09.2022 (A-12) from the date of their appointment/joining viz. June 2021 with all admissible consequential monetary benefits to which the applicants may be found entitled to under rules and law along with interest @ 18% per annum in the interest of justice.

The factual matrix of the case is that Respondent PGIMER issued advertisement dated 11.12.2018 (A-3) inviting online applications for recruitment to various Group-B and Group-C posts on regular basis in PGIMER, Chandigarh including relevant 05 posts of Assistant Administrative Officer. The applicants, who were earlier working as Digitally signed by Officers in various Nationalized Banks of India, fulfilling the desired eligibility criteria for the post of AAO, applied against the said post, the written examination for which was held on 05.05.2019. The respondent PGIMER issued notice dated 16.08.2019 (A-4) mentioning the names of all the persons who have been found eligible/provisional eligible and not eligible for consideration for the post of Assistant Administrative Officer.
3. On the basis of marks obtained in the written examination, the PGIMER issued notice/provisional result dated 24.01.2020 (A-5) wherein the names of all the provisionally Selected/Waitlisted candidates including all the 03 applicants, were declared and they were directed to appear for verification of original document. The PGIMER declared final result vide notice dated 06.03.2021 (A-6) the perusal of which categorically shows that all the 03 applicants were selected for the posts of Assistant Administrative Officer in respondent PGIMER and accordingly were issued separate and similar appointment orders dated 13.03.2021 (Annexure A-7) to the post of Assistant Administrative Officer in PGIMER and they joined the said post on 17.06.2021 and
25.06.2021 respectively.
