PER: - MR. KUMAR RAJESH CHANDRA, MEMBER [A]

The applicant has approached this Tribunal under Section 19 of the

Administrative Tribunals Act, 1985 praying for the following relief:

“8 (1) That your Lordships may graciously be pleased to direct the

concerned respondents to revise the payment of pensionary benefits such as

Pension, DCRG, commuted value of Pension, Leave encashment etc at correct

rate i.e., based on pay of Rs. 58,600/- + Grade Pay of Rs. 4200/- to which the

applicant is legally entitled.

8 (2) Any other order or orders as your Lordships may please deem fit

and proper in the interest of justice.

8 (3) Cost of the case may please be awarded to the applicant for

unnecessary expenditure incurred in litigation, mental agony, financial

harassment, sorrow, suffering and pain.”

2. For the sake of clarity, facts in the case as stated by the applicant in

his OA, are delineated and discussed herein under :-

The Applicant superannuated from the post of Senior Section

Engineer (C&W), E.C. Railway, Barauni Junction on 31.01.2021.

At the time of retirement, the Applicant was drawing a Basic Pay of

Rs. 58,600/- as is evident from his Pay Slip for December, 2020.

However, in the PPO dated 27.01.2021, his last Basic Pay was shown as

Rs. 56,900/- instead of Rs. 58,600/-. As a result of such downward

revision of Basic Pay at the verge of retirement, the Respondents

calculated and paid the Applicant’s pension, DCRG (Death-cum-

Retirement Gratuity), commuted value of pension, leave encashment and

other retiral benefits on the reduced Basic Pay of Rs. 56,900/-. The

Applicant was never issued any show cause notice nor afforded any
