ORAL ORDER

(Pronounced by Hon'ble Mr. M. Swaminathan, Member(J))

In the instant OA, the applicants seeks the following relief:

“i. to call for the records relating to the impugned

Notification issued by the 2nd respondent, vide Proceedings

No.A1818/ DSE / Estt.IV/C/2023, dated 12.09.2025, and

quash the same,

(ii) And further Direct the respondents to make

re-notification for recruitment to the post of Primary School

Teachers, duly following the Rule of Reservation, duly

adopting the employment seniority from the original date of

registration, and adopting all procedures as per the

Recruitment Rules for the post of Primary School Teachers,

and pass such further or other orders as this Tribunal deems

fit and proper and thus render justice.”

2. Brief facts of the case as submitted by the applicants are as follows:

The applicants have completed their Diploma in Teacher Training and have also

qualified in the Teachers Eligibility Test (TET). Accordingly, they are fully

eligible for appointment to the post of Primary School Teachers under the

Government of Puducherry. On 12.09.2025, the respondents issued a

notification inviting applications for direct recruitment to the post of Primary

School Teachers. A total of 190 vacancies were notified, of which 181 vacancies

pertain to the Puducherry and Karaikal regions and 9 vacancies pertain to the

Mahe region. In the impugned notification, while prescribing the age limit, the

respondents failed to give due consideration to G.O.Ms.No.50 dated 29.07.2022.

Further, the notification provides that employment exchange seniority shall be

computed from the date of registration of the TET qualification. Since TET is

only a qualifying examination and not a competitive examination, fixing

seniority based on TET registration is arbitrary and contrary to the rule of law.

The impugned notification has also completely omitted the Meritorious Sports

Person (MSP) quota under the horizontal reservation category. Additionally, the

rules of reservation, both vertical and horizontal, have not been properly

followed in the recruitment process. Thus, the impugned notification issued by

the respondents is unconstitutional, arbitrary, and violative of the established

rules of reservation. The last date for submission of online applications is

14.10.2025. Hence, the present Original Application is filed challenging the

impugned notification.

3. When the matter was taken up for admission, the learned counsel for the

applicants submitted that the impugned notification dated 12.09.2025, issued

for recruitment for the post of Primary School Teachers deprives the right of

eligible and qualified candidates. The procedures adopted, the categories under

which the recruitment is done, the rule position adopted, the rule of reservation

followed, the region wise priority given, are all in total controversy and in

complete violation of the basic recruitment rules prescribed for Primary School

Teachers. It is further submitted that the respondents have failed to consider the

age-relaxation provided under G.O. Ms. No. 50 dated 29.07.2022 while fixing

the upper age limit.
