Present OA has been filed by the applicants for the following reliefs:-

“(8.1) Your Lordships may graciously be pleased to admit this application, issue notice to show cause as to why the applicants be not granted the benefit of Grade Pay of Rs.4600 and 4800 under the MACP Scheme and after hearing the parties your Lordships may further be pleased to direct the respondents to extend the benefit of Grade pay of Rs.4600 and 4800/- in favour of the applicants as was granted to their counter parts setting aside the order impugned dated 12.07.2016 whereby and whereunder applicants have been denied benefit of grade pay under MACP scheme.

(8.2) Your Lordships may further be pleased to direct the respondents to compute and pay the applicants their retrial benefits taking into consideration of Grade Pay of Rs.4600 and 4800/- as was given to their counter parts setting aside the orders impugned dated 12-07-2016.

(8.3) Any other order/ orders, relief/reliefs as your Lordships may deem fit and proper in the facts and circumstances of the case.”

2. Brief facts of the case as emerged from the pleadings are that the applicants namely Sri Manoj Bihar, Sri Amar Singh, Sri Prem Sagar Prasad & Late Birendra Kumar were initially appointed as Goods Guard in the year 1974, 1975 and 1976 respectively. They were posted as Guard ‘B’ in the Pay Scale Rs.330-560/-. Subsequently they were promoted to the post of Passenger Guard and thereafter Guard Mail Express in the Pay Scale of Rs. 1400-2600/- which was later revised in the pay scale of Rs. 5000-8000/- in the 5^th CPC and finally the said pay scale was merged to the pay scale of Rs.5500-9000/-

3. Applicant Nos. 1,2, and 3 and later on husband of applicant no. 4 approached this Tribunal through O.A. Nos. 141,140, 241 and 146 Digitally of 2014 respectively seeking direction to the concerned Authority/respondents to extend the benefit under the Modified Assured Progression Scheme (M.A.C.P. Scheme) as was given to their counter parts working under Mugalsarai Division of the East Central Railway in-terms of Judgments rendered by the Hon'ble C.A.T., Allahabad which was affirmed by the Hon'ble Allahabad High Court.
