O R D E R

By Hon’ble Mr. Rajnish Kumar Rai, Member (J):-

Heard Shri Nand Lal Yadav holding brief of Shri M K Upadhyay, learned counsel for the applicant and Shri Devendra Narayan Pandey, learned counsel for the respondents are present.

2. This instant Contempt Petition has been filed under Section 17 of the Administrative Tribunal Act 1985 for non-compliance of the order dated 02.12.2022 passed by this Tribunal in O.A.

No.1511/2012.

3. Learned counsel for the respondents submitted that the compliance has been made out and accordingly, same may be dismissed.

4. Learned counsel for the applicant objected and submitted that the matter may be adjourned, as arguing counsel is busy in the Hon’ble High Court.

5. Considering the order and direction issued by this Tribunal dated 02.12.2022, which is quoted herein below:-

“12. In the instant case, since suspension order has been revoked by the respondents, applicant has been reinstated, respondents ought to have passed specific order regarding the pay and allowances of suspension period. Similarly, only minor penalty of Censor entry has been awarded upon the applicant in place of dismissal and the applicant has been reinstated and is working on his post continuously. Thus, as per the case laws discussed hereinabove, applicant is entitled for salary and other allowances for the suspension period as well as for the dismissal period along with consequential benefits.

13. Accordingly, the O.A. is allowed. Respondents are directed to pay full salary and allowances to the applicant for the suspension period i.e. from 17.2.2005 to 3.11.2005 (suspension period) and from 30.10.2006 to 26.10.2010 (Dismissal period) with other allowances and all consequential benefits, within a period of one month from the date of receipt of certified copy of this order.”

6. Counsel for the respondents submitted that earlier affidavit was filed on 27.08.2024 and reliance placed on Annexure 1 at page 7 regarding order dated 06.05.2023 and submitted that in pursuance to the direction issued by this Tribunal, the respondent authorities has considered, as under:-

“payment of arrears of TRCA & allowance together with consequential benefits for suspension period i.e. from 17.02.2005 to 03.11.2005 and for the dismissal period i.e. from 30.10.2006 to 26.10.2010 to Shri Santlal Ex GDS BPM Sonhara, Bardah.

Therefore, in this regard A-Roll amounting to Rs.322833/- (Three Lac Twenty two Thousand Eight Hundred Thirty Three Only) is being sent h/w for crediting Rs.322833/- in the SB account no.2823818503 standing at Bardah PO and charge the same under GL 3022170101 under intimation the date of payment to this office”

Considering the submission of learned counsel for the parties, we are in opinion that compliance has been made out by the respondents and accordingly, the contempt petition is dropped and notice issued, if any, against the alleged contemnor are discharged. However, liberty is open to the applicant, if aggrieved, against the order dated 06.05.2023 passed by the respondents, may approach appropriate forum, if so advised.
