ORDER (ORAL)

In the present Original Application filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant seeks the following reliefs:-

“(i) Set aside the impugned Notice No. 142 dated 13.06.2022, issued by the Delhi Subordinate Services Selection Board (DSSSB), whereby the Delhi Subordinate Services Selection Board (DSSSB) failed to consider the candidature of the applicants for appointment on the post of TGT (Hindi) (Female) (Post Code: 33/21) in Directorate of Education (DOE), under EWS category and directed the applicants herein to upload the EWS Certificates issued by a Competent Authority before the cut off date, i.e. 24.06.2021;

(ii) Declare that the Income and Asset Certificates (I & A Certificate) are legal, valid and sufficient document/certificate for appointment under Economically Weaker Sections (EWS) category on the post of TGT (Hindi) (Female) (Post Code: 33/21) in Directorate of Education (DOE);

(iii) Direct the respondents to consider the candidature of the applicants under Economically Weaker Sections (EWS) category for appointment on the post of TGT (Hindi) (Female) (Post Code: 33/21) in Directorate of Education (DOE) and, thereafter, appoint the applicants on the post of TGT (Hindi) (Female) (Post Code: 33/21) in Directorate of Education with all consequential benefits (monetary as well as non- monetary) thereof including the seniority, back wages/salary, etc.;

(iv) allow the present Original Application with costs in favour of the applicants;

(v) issue any other appropriate order or direction as this Hon'ble Tribunal may deem fit and proper in the interest of justice and in the favour of the applicants;”

2. Brief facts of the case as narrated by learned counsel for the applicants are as under:-

2.1 The applicants had applied for the post of TGT (Hindi) (Female), Post Code 33/21, Group ‘B’, pursuant to advertisement issued by the Delhi Subordinate Services Selection Board (DSSSB). The closing date for submission of the online application form was 24.06.2021. The applicants belong to the Economically Weaker Section (EWS) category and are entitled to reservation benefits under Office Memorandum dated 31.01.2019 issued by Government of India and Office Memorandum dated

04.06.2019 issued by Govt. of NCT of Delhi.
