ORDER (ORAL)

The present O.A. has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985, seeking following reliefs:-

“8. a) To quash and set aside the Impugned order no. F.11/206/H&FW/HR-Med./2025/#112807742/ 2137-41 dated 13.08.2025 (ANNEXURE-A-1) whereby the candidature of the applicant for the post of medical officer GDMO Sub-Cadre under Health & Family Welfare Department, Govt. of NCT OF Delhi, has illegally, arbitrary and discriminatory manner been cancelled by the respondents in the interest of justice.

b) To direct the respondent to give extension to the applicant till 4th December 2025 to join his place of posting by removing his cancellation for the post of medical officer GDMO Sub- Cadre under Department of Health & Family Welfare, Govt. of NCT of Delhi, for the reasons as discussed in the para 4 & 5. of the OA in the interest of justice.

c) To direct the respondent to allow the applicant to join the post of Medical Officer GDMO Sub- Cadre under Department of Health & Family Welfare, Govt. of NCT of Delhi, after completion of his M.D. course in Radiotherapy/Radiation Oncology till 4th December

2025 in the interest of justice.

d) Allow this OA with all consequential benefits in the favour of the applicant.

e) Any other relief, the Ld. Tribunal may deem fit and proper in the facts and circumstances of the case.”

2. Learned counsel for the applicant states that acommon order for cancellation of the candidature ofthe applicant has been issued by the respondents SHILPI GUPTA2026.02.24without giving any reason. He draws attention to Annexure-A/15, wherein the following persons have already been given extension of time to accept offerletter/joining:-

At this stage, learned counsel for the applicant submits that the applicant would be satisfied if he may be permitted to make a comprehensive representation to the respondents and the respondents be directed to dispose of the said representation by way of passing a reasoned and speaking order in light of the fact that the above mentioned persons have already been granted extension of time to accept offer letter.

4. Issue notice. Mr. R V Sinha, learned counsel,appears and accepts notice on behalf of the respondents. He seeks sometime to take appropriate instructions in the matter.

5. In view of the prayer made by the learned counsel for the applicant, the applicant is directed to make a comprehensive representation to the competent authority amongst the respondents within a period of 10 days from the date of issue of a certified copy of this order and the respondents are directed to dispose of the representation so made by the applicant, by passing a reasoned and speaking order, within a period of thirty days from the date of receipt of the same in light of the fact that 14 persons have already been accorded extension of time. A copy of the speaking order so passed be given to the applicant.

6. The O.A. is disposed of in the aforesaid terms, without going into the merits, at the admission stage itself. Pending MAs, if any, shall also stand disposed of accordingly.

7. No order as to costs.
