Per Kumar Rajesh Chandra, A.M.:-This OA has been filed by the applicant seeking the following relief:-

(i) That Your Lordship may graciously be pleased to quash and set-aside the order dated 12.12.2024 as contained in Annexure A/1 together with orders dated 08.07.2020, 17.07.2020 and 04.02.2021 passed for the Respondent No. 4 whereby the basic pay of applicant already fixed to Rs. 43,600/- has been reduced to Rs. 38700/- as on 01.07.2018 ordered which is illegal, discriminatory, arbitrary, unconstitutional and violative of Article

14, 16, & 21 of the Constitution of India.

(ii) That, Your Lordships may graciously be pleased to direct/command Patna Bench the respondents to accord/grant/fix the basic pay scale of applicant at par with pre-28.07.2016 promoted co-employees, selected/empanelled vide Annexure-A/4 dated 25.05.2016 along with applicant to avoid any discrimination.

(iii) That your Lordships may graciously be pleased to direct/command the respondents to restore the basic pay of applicant as Rs. 43600/- as on

01.07.2018 instead of Rs. 38,700/- henceforth.

(iv) That Your Lordships may graciously be pleased to direct/command the respondents to refund the amount already recovered towards overpayment/excess payment henceforth along with statutory interest.

(v) That your Lordships may graciously be pleased to hold and declare the TRBE 90/2016 and Railway Board order dated 10.07.2019 as contained in Annexure-A/7 and A/8 as discriminatory, inapplicable and per se illegal in respect of adopting two yardsticks amongst pre-28.07.2016 and post 28.07.2016 promotees selected on 25.05.2016 against one and same select panel.

(vi) That your Lordships may graciously be pleased to direct/command the respondents to grant all consequential benefits including arrears of pay etc. with statutory interest.

(vii) Any other relief or reliefs including the cost of the proceeding may be allowed in favour of the applicant.”

2. The facts of the case, as narrated by the applicant in his OA, are as follows:-

(i) The applicant was initially appointed as Assistant Loco Pilot (ALP) in pay band of Rs. 5200-20200/- GP of Rs. 1900/- on 15.05.2007 through RRB, Ranchi. While working as such he was promoted to the post of Senior Assistant Loco Pilot (Sr. ALP) in the pay band of Rs. 5200-20200 GP Rs. 2400/-

in the year 2010.

(ii) While the applican
