(C) Competence of authority - Termination by director held competent; no evidence adduced to contrary. (Para 14)
Facts of the case:
Applicant appointed as Administrative-cum-Finance Officer on term-contract basis for five years, joined after one-year probation commenced. Probation report considered by committee; services discharged after 16 months citing unsatisfactory performance and non-completion of probation, per offer terms. Challenged termination as illegal, by incompetent authority, discriminatory, seeking reinstatement, regularization.
Findings of Court:
Impugned termination order lawful, in accordance with appointment offer and rules; probation not automatically confirmed, termination valid simpliciter based on performance review.
Issues: Validity of termination pre-two-year period per rules; applicability of probation to contract employee; competence of terminating authority; entitlement to regularization vis-à-vis similarly placed employee; stigmatic nature requiring notice.
Ratio Decidendi: Offer of appointment governs; failure to complete probation permits discharge without notice or reason if non-stigmatic; employee estopped from inconsistent pleas; no regularization post-valid termination.
Result: Application dismissed.

The OA also alleges that the applicant has been subjected to discriminatory treatment by the department as one similarly placed employee was granted the benefit of regularization while the applicant was terminated. The OA further alleges that the requisite and compulsory provisions enshrined in the relevant services rules have not been followed so much so that the extant policy of the central government has also been violated by the department.
