ORDER (ORAL)

The present Original Application is being filed under Section 19 of the Administrative Tribunals Act, 1985, whereby the applicant seeks the following reliefs:

“(i) The impugned final answer key (Annex.A/1) to the extent of question ID 60092912863 may kindly be quashed and set aside (ii) The Respondent may kindly be directed to award the marks of question ID 60092912863 to the applicant by considering his right answer and declare the result of applicant afresh.

(iii) The Respondent may further be directed to constitute an expert committee for examining the answer of question ID 60092912863 and if any discrepancies have been found, then issue fresh answer key and revised the result of applicant accordingly and if applicant found place in merit, he may be shortlisted for further selection process and also given appointment to him on the post of Trained Graduate Teacher (Hindi)

(iv) or in alternate the Respondent may further be directed to consider and decide the representations dated 22.2.2022 (A/2) of the applicant and give appointment to the applicant on the post of Trained Graduate Teacher (Hindi) Male with all consequential benefit.

(v) Any other directions and orders, which are, deem proper in the facts and circumstances of the case may kindly be allowed to the applicant.”

2. Highlighting the facts of the present case, learned counsel for the applicant would submit that the case of SHILPI GUPTA the applicant pertains to challenge the impugned final answer sheet.

2.1. Learned counsel for the applicant draws attention to draft answer key, wherein the impugned question ID

60092912863 and its answer is highlighted as under:-

“Q.7 िन(cid:635)िल्खत ঋ(cid:690) म७, चार िवक(cid:665)ों म७ से, उस िवक(cid:665) का चयन कर७ जो वाভांशों के िलए एक श(cid:616) का सही िवक(cid:665) हो।

In the draft answer key the correct answer has been marked to as B. ‘पांडुिलपी’.

2.2. He states that later on the respondents uploaded a final answer key, though of a different booklet the answer of the impugned question ID 60092912863 is shown as √ B. ‘ह(cid:721)िल्खत’.

2.3. He draws reference to Annexure-RJ-5 of the rejoinder in which the same question has been asked in the examination conducted by Navodaya Vidyalaya Samiti, as question no. 17 and the correct answer of the same is marked as Pandulipi.

2.4. He also draws reference to Annexure-RJ-4, which is a response to his RTI application dated 25.08.2023 from NCERT, which reads as under:-
