Per : Hon’ble Mr Justice Rameshwar Vyas Heard learned counsel for the parties on preliminary objection raised by the respondents with regard to having territorial jurisdiction of this Bench over the dispute involved in the instant OA.

2. The facts in brief are as under:-

2.1 the applicant who is resident of Lunkaransar, Bikaner, Rajasthan which is situated within the territorial jurisdiction of Jodhpur Bench participated in recruitment against sports quota for the year 2023-24 pursuant to Employment Notice No. 02/2023 advertised by Northeast Frontier Railway (NFR), Maligaon, Guwahati (Assam).

2.2 When the selection committee did not select the applicant, she filed a complaint dated 20.03.2024 (Annex. A/1) to the General Manager, NFR Guwahati Assam. After failing to get any relief at administrative level, she filed an OA before the Principal Bench of the Central Administrative Tribunal with Petition to Transfer (PT) No. 122/2024 seeking to permit the case before the Principal Bench, New Delhi. However, after arguing for some time learned counsel for the applicant sought leave of the Tribunal to withdraw the PT with liberty to file the OA before the Jodhpur Bench of Tribunal. Vide order dated 17.05.2024, leave with liberty was allowed and PT was accordingly dismissed as withdrawn.

2.3 Thereafter, the applicant has approached this Bench by filing the instant OA against her non-selection wherein she arrayed the person who was selected against the post as party respondent No. 5.

3. Now, the preliminary objection has been raised by learned counsel for the respondents that this Bench does not have territorial jurisdiction over the matter. He further submits that Hon’ble Chairman, Central Administrative Tribunal vide order dated 17.05.2024 has not decided the issue of having territorial jurisdiction of this Bench to hear the matter. Otherwise also, the powers under Section 25 of the Administrative Tribunals Act, 1985 to transfer cases from one bench to any other bench is an administrative power of the Chairman, CAT.
