2. The present C.P. has been filed alleging non-compliance of the order dated 22.01.2025 passed in O.A. No. 1171/2023. By the said order, the respondents were directed to consider the applicant for grant of further promotion, which had earlier been denied on account of the pendency of disciplinary proceedings against him. It was further directed that the said exercise be carried out within a period of eight weeks from the date of receipt of a copy of the order.

In compliance with the aforesaid directions, the respondents passed an order dated 23.07.2025, whereby the applicant was promoted to the grade of Commissioner of Customs and Indirect Taxes in the Indian Revenue Service. However, the promotion was granted on a notional basis with effect from 01.09.2022 and on an actual basis from the date of assumption of charge of the post.

4. The grievance raised by Mr. Bhardwaj, learned counsel for the applicant, is that once the applicant was fully exonerated, his promotion could not have been granted only on a notional basis with effect from 01.09.2022.

5. The respondents challenged the order of this Tribunal by filing W.P.(C) No. 1111/2026 before the Hon’ble Delhi High Court. The said writ petition was disposed of by order dated 27.01.2026. The Division Bench of the High Court observed that the direction issued by this Tribunal was only to consider the applicant for grant of further promotion with consequential benefits and that the same had been complied with by the respondents by passing the order dated 23.07.2025. It was, therefore, held that no case for contempt was made out. The High Court further granted liberty to the applicant to challenge the said order dated 23.07.2025 by initiating appropriate proceedings.

6. In view of the above circumstances, we find that nothing survives for consideration in the present C.P. The same is accordingly closed. Needless to state that the applicant is at liberty to challenge the order dated 23.07.2025 by initiating appropriate proceedings before the competent forum, in accordance with law.
