By this O.A., applicant makes a prayer for setting aside the impugned Order No. B-1/Ngn/RT/TSPA dated 02.05.2025 (Annexure-A/1) and Order No. B-15/10018501 dated 14.05.2025 (Annexure-A/2) issued by the Superintendent of Post Offices, Nagaon Division, Nagaon and for a direction upon the respondents to grant exemption him from the routine exercise of transfer/rotational transfer in view of the guidelines prescribed by the Central Government from time to time.
2. The applicant was appointed in the post of Postal Assistant on 27.02.2003 by the Superintendent of Post Offices, Nagaon Division, Nagaon. During his service period, he worked in various offices i.e. Bokajan SO, Diphu O.A. No./142/2025 PRASANNA Digitaly signed by BASUMATARYP B R AS A U SA M SO, Ambagan SO, Dhing SO, Juria SO and Garajan Bazar SO. Applicant submitted a representation dated 17.02.2025 before the respondent No. 4 seeking a transfer and posting at Nagaon Town Area during the exercise of rotational transfer on the ground that his younger son has been suffering from Autism Specturm Disorder having 80% permanent disability in relation to his brain. Along with his representation, applicant also submitted an ‘Option Form’ citing 3 places of his choice for posting on transfer, which are-(a) Nagaon Girls College, SO, (b) Itachali SO and (c) Haibargaon S.O. However, without considering his representation dated 17.02.2025, the respondent No. 4 vide Order dated 02.05.2025 had transferred the applicant from Nagaon H.O. to Moirabari S.O. as a part of rotational transfer violating the OM dated 08.10.2018 and 02.02.2024 with regard to exemption from routine exercise of transfer/rotational transfer in respect of government employee, who is a caregiver of the person with disability dependents. As per the applicant, one post was vacant at Nagaon Girls College S.O. wherein applicant could be posted on transfer from Nagaon S.O. Being aggrieved with O.A. No./142/2025 PRASANNA Digitaly signed by BASUMATARYP B R AS A U SA M the aforesaid impugned transfer Order, applicant submitted another representation dated 08.05.2025 before the respondent No. 4 for reconsideration of his transfer. In the said representation, applicant specifically stated as follows:
“my younger son namely Md. Abrar Al Jamee, age 7 yrs having special disability with Autism Spectrum Disorder (ASD). He has 80% permanent disability in relation to his brain. Hence he is not able to communicate with people, always on the run and increased psychomotor activity and he has been under treatment here at Nagaon town. I have to carry him twice daily in the morning and evening to the physiotherapists clinic and any disruption to this routine would be detrimental to his progress and well being.”
