O R D E R

Per: RAMESH SINGH THAKUR, MEMBER (J):

1. The applicant has approached this Tribunal by way of instant O.A, under Section 19 of the Administrative Tribunals Act 1985, seeking the following relief:

“i) the records of the case may kindly be called for perusal of the Hon'ble Tribunal.

ii) This Hon'ble Tribunal may quash the impugned letter dated 10.05.2018 (Annexure A/23) confining the eligibility of Anganwadi workers for promotion to the post of Supervisor as on 31.05.2016 being wholly illegal, unlawful, arbitrary and unconstitutional and further in violation of principles of natural justice.

iii) And direct the respondent No.2 & 3 to consider the case of the applicant for promotion to the post of Supervisor as per her seniority from the date when the candidates junior to the applicant were promoted with all consequential benefits.

iv) And further direct the respondent No.2 & 3 to place the promotion orders of respondent No.4 to the post of Supervisor on record and quash the same if so warranted in the facts and circumstances of the case and further in case no post of Supervisor is available to adjust the applicant.

v) pass any order or direction or grant, any other relief to which the applicant is found to be entitled in the facts and circumstances of the case.”

2. Brief facts of the case as submitted by the applicant are that the applicant passed her Matriculation Examination in March, 1984 from the Haryana School Education Board, Bhiwani (Annexure A-1). She thereafter passed the Senior Secondary (10+2) Examination in March, 2002 from the Punjab School Education Board (Annexure A-2). Subsequently, the applicant acquired the degree of Bachelor of Arts (B.A.) from Desh Bhagat University, Mandi Gobindgarh (Annexure A-3). Upon declaration of her B.A. result, the applicant informed the respondent Department and submitted a downloaded marksheet along with a representation dated 09.05.2018, which was duly diarised on 10.05.2018 (Annexure A-4).

The applicant submits that she was initially appointed as an Anganwadi Worker by the Director, Social Welfare, Chandigarh Administration, vide office order dated 01.08.1995 (Annexure A-5), and she joined duty on 03.08.1995 (forenoon), the appointment was on temporarily and part-time basis. The applicant continued to work uninterruptedly and was called for interview for appointment as Anganwadi Worker on regular basis vide memo dated 10.05.1996 (Annexure A-6). Consequent upon the interview, she was again appointed as Anganwadi Worker under the ICDS Scheme vide appointment order dated 16.05.1996 (Annexure A-7), and she submitted her joining report on 17.05.1996 (Annexure A-8). The applicant was posted at different Anganwadi Centres from time to time and is presently posted at Anganwadi Centre No.1, Khuda Ali Sher, U.T. Chandigarh.
