The present Original Application has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:-

“8(i). That the entire record relating to the case be called for and after perusing the same respondents may be directed to allow notional benefits of promotion to the post of Director General to the applicant at par with Shri M.M.Singh Suman by quashing order dated 08/07/2009 (Annexure – A/1) with the DPC minutes dated 28/01/2003 (Annexure – A/4) with all consequential benefits.

8(ii). That the respondents be further directed to revise pension & pensionary benefits after allowing notional benefits and to extend the same by modifying orders/ PPO etc with all consequential benefits.

8(iii).Any other order, direction or relief may be passed in favour of the applicant, which may be deemed fit, just and proper under the facts and circumstances of the case.

8(iv). That the costs of this application may be awarded.”

The brief facts of the case, as stated by the applicant, are that the respondent No.1 has passed an order dated 08.07.2009 (Annexure A-1) which is impugned in the present OA by which applicant was informed that his case cannot be reopened. However, as per DPC, one Shri M.M.Singh Suman was selected for the post of Director General.

As such, applicant approached before the Calcutta Bench of this Tribunal and, thereafter, Hon’ble High Court of Calcutta and after passing of the impugned order dated 08.07.2009, he preferred a Contempt Petition before the said High Court, which was dismissed on 10.07.2019 and applicant was granted the liberty to assail the said impugned order dated before the appropriate forum and even his delay in filing was also condoned. Further, applicant was pursuing the matter since 2001 and at present, he is before this Bench of Tribunal for claiming notional benefits at par with Shri M.M.Singh Suman.

After notice, the respondents have filed their reply and contested the OA and supported the impugned order dated 08.07.2009 (Annexure A-1) passed by the respondents in which it has been submitted that the case of applicant cannot be reopened against the selection of Shri M.M.Singh Suman for the post of Director General of Lighthouses and Lightships as the vacancy arose on 01.12.2002 and as per the new Recruitment Rules which came into force on 09.10.2002 with the provision of “junior-senior”, the selection of said Shri M.M.Suman Singh is on the basis of new Recruitment Rules, which was absolutely fair and justified.

3(a). It is also submitted that the Hon’ble High Court of Calcutta has observed in its judgment dated 21.01.2008 that “he should be given notional benefits with retrospective effect. However, no pecuniary benefits shall
