ORDER (ORAL)

Since a common question of facts and law is involved in the present OAs, with the consent of all parties the OAs were being heard together and are being disposed of by this common order. However, for the sake of brevity, the facts are being extracted primarily from O.A. No. 525/2024 (Jatin Kumar Vs. Staff Selection Commission & Ors.).
2. By way of the present O.A. the applicant seeks following reliefs:-
“i. Call for records of the case;
ii. Pass an order directing the respondents to declare the result of the applicant under EWS Category for the post of Constable (Exe.) – Male and include the name of the Applicant in the final merit result dated 24.01.2024; iii. Pass an order directing the Respondents to appoint the applicant to the post of Constable (Exe.) Male along with all consequential benefits including arrears, etc.
alongwith interest at GPF rates;
iv. Award cost of the proceedings; and v. Pass any order/relief/directions(s) as this Hon’ble Tribunal may deem fit and proper in the interest of justice in favour of the applicant.”
3. Highlighting the facts of the present case, learned counsel for the applicant would submit that the SHILPIS HILPI GUPTA GUPT
2026.03.09 applicant was having two relevant certificates in question, one dated 11.01.2024, valid till 2023-24, annexed as Annexure-A/4, which reads as under:-
“VALID FOR THE YEAR: 2023-24 This is to certify that Shri JATIN KUMAR son of Shri RAJESH permanent resident of House No-182, Street No-00, LandMark-VPO RATTAN THAL, Pincode-123301, Village RATTANTHAL. Post Office RATTANTHAL, District REWARI in the State HARYANA Pin Code 123301 whose photograph is attested below belongs to Economically Weaker Sections, since the gross annual income of his/her "Family*** is below Rs. 8 lakh (Rupees Eight Lakh only) for the financial year 2022-23. His/Her family does not own or possess any of the following assets***
I. 5 acres of agricultural land and above.
II. Residential flat of 1000 sq. ft. and above.
III. Residential plot of 100 sq. yards and above in notified municipalities.
IV. Residential plot of 200 sq. yards and above in areas other than the notified municipalities.
2. Shri JATIN KUMAR belongs to the 'RAJPUT' caste which is not recognized as a Scheduled Caste, Schedule Tribes and Other Backward Classes (Central List).”
