In the present Original Application, the applicant seeks the following relief(s):-
“i) direct the respondents to allow the applicant the facility of a Scribe for appearing in the selection test qua post code 42/2025 in pursuance of Advt. No.02/2025 issued by respondent no.3 for appointment to the post of Special Educator under the Directorate of Education, GNCTD;
AND/OR AKANSHA ii) pass such other order/s as may be deemed fit proper.”

3. Sh. Amit Anand, learned counsel for the respondents, entered appearance. At the outset, he submitted that the respondents have no objection to provide a scribe to the applicant, provided that the applicant fulfils the stipulations contained in the Office Memorandum dated 29.08.2018. He further submitted that the facility of a scribe is allowed to the applicant with benchmark disability as defined under section 2(r) of the RPwD Act, 2016 and has limitation in writing including that of speed is so desired by her. He submitted that in case of persons with benchmark disabilities in the category of blindness, locomotor disability (both arm affected BA) and cerebral palsy, the facility of scribe assistant shall be given, if so desired by the person.
He submitted that in case of other category of persons with benchmark disabilities, the provision of scribe can be allowed on production of a certificate to the effect that the person concerned has physical limitation to write, and scibe is essential to write examination on his behalf, from the Chief Medical Officer/Civil Surgeon/Medical Superintendent of a Government health care institution as per proforma at APPENDIX-I.

drew attention to a case titled Santosh Kumar, wherein the respondents had provided a scribe to Sh. Vinod Kumar Gupta. Para 6 of order dated 29.10.2025 reads as under:-
“6. As per the documents available on record and verified by the DSSSB, Sh. Vinod Kumar Gupta has submitted a valid disability certificate showing 60% Locomotor Disability (PPPRP Left Lower Limb). Thus, being a person with disability of more than 40%, he was eligible to avail the facility of scribe under the above-mentioned Government of India guidelines, if he so desired.”

In view of the aforesaid submissions and the position explained by the respondents, it is incumbent upon the applicant to comply with the conditions stipulated in the Office Memorandum dated 29.08.2018. The applicant shall be at liberty to bring a scribe; however, the same shall be subject to the stipulation that the applicant produces a certificate in the prescribed format issued by the Chief Medical Officer/Civil Surgeon/ Medical Superintendent of a Government Hospital, certifying that despite having a benchmark disability of 40% or more, the applicant is unable to write. The applicant shall also furnish an undertaking from the scribe in the prescribed format.
6. Accordingly, the OA is disposed of in the aforesaid terms. No costs.
7. All pending MAs, if any, shall also stand disposed of.
