Per: RANJANA SHAHI, JUDICIAL MEMBER

The applicant has filed the present O.A. aggrieved by the

transfer order dated 21.04.2025 (Annexure A/1) vide which she had been transferred from Akashvani, Jaipur to DG: Akashvani (New Delhi) and also seeking quashing of the order dated 18.06.2025 (Annexure A/1C) vide which additional charge of her present post was given to respondent No. 3, Reshma Khan, Assistant Director, Programme, Prasar

Akashvani, Jaipur; mainly on the following grounds: -

(i) that the applicant is due to retire on 31t July, 2026

i.e. almost 15 months before her retirement, she has been transferred for which she relied upon the transfer policy of Prasar Bharti, New Delhi issued

vide OM dated 26.03.2021 (Annexure A/2);

(ii) that there are number of Deputy Director

Programmes (DDPs) working in Delhi and Shri Raj Kumar Nahar and Shri Amrendra Kumar are posted

at Delhi;

(iii) that she is being transferred not because of

administrative exigency but in order to accommodate Ms. Reshma Khan (respondent no.

3).

OA No. 318/2025 3 2. This Bench of the Tribunal while issuing notice to the respondents on 24.06.2025 stayed the impugned transfer order dated 21.04.2025 (Annexure A/1), order dated 11.06.2025 and 17.06.2025 qua the applicant and ordered the official respondents to allow the applicant to work as DDP,

Akashvani, Jaipur.

3. The official respondents (respondent Nos. 1 & 2) in their reply have emphasized that there is acute shortage of SST level officers in Akashvani and there were only 05 Deputy Director Programmes (DDPs). They have annexed Annexure SR/1 detailing the status of DDPs at various Akashvani

stations which is as follows: -

Besides, the official respondents have also stated that

the transfer policy on which the applicant has relied clearly stipulates the categories for transfer in which the transfer will generally be carried out as “transfer on administrative

requirements which may be carried out to meet specific

OA No. 318/2025 4 requirement of post of desirable expertise, due to promotion, etc. in accordance with the guidelines/instructions issued from time to time. They have further stated that as per the stipulation qua the officers due to retire within two years of superannuation, shall normally not be transferred except in case of “administrative exigencies”, which is applicable in the case of the applicant. They have further said that through the impugned transfer order as many as 11 officers have

been transferred.
