CENTRAL ADMINISTRATIVE TRIBUNAL
Urmita Datta (Sen), Judicial Member, Suchitto Kumar Das, Administrative Member
V.P. Babu – Appellant
Versus
Union of India – Respondent
O.A.No.351/1670/2024(AN)

Advocates:
For the Applicant: Mr. Gopala Binnu Kumar, Counsel
For the Respondents: Mr. R. Kumar, Counsel

FMA for routine expenses does not bar reimbursement of specialized medical treatments for pensioners.

Headnote:First Paragraph: Under Section 19 of the Administrative Tribunals Act, 1985, retired government employee sought reimbursement of medical expenses for heart and eye treatments, claiming Rs.4,70,743/- after rejection citing fixed medical allowance (FMA), non-opted CGHS, and available Pradhan Mantri Jan Arogya Yojana benefits. Court found entitlement persists despite FMA for specialized treatments. Second Paragraph: Key issue was whether FMA bars reimbursement for serious ailments. Ratio: FMA covers routine expenses only; does not waive rights to reimbursement for life-threatening treatments, as affirmed in precedents emphasizing health rights of pensioners in non-CGHS areas. Third Paragraph: Impugned rejection order quashed; respondents directed to reimburse verified claims within 3 months.
