ORDER
The applicant has filed this Original Application under
Section 19 of the Administrative Tribunals Act, 1985 seeking the
following reliefs:
“8.a This Hon'ble Tribunal may kindly please to take into consideration the provisions of the Rule 21 of the Railway Services Conduct Rules 1966, Pension Rules 1993 in regard to the Muslim Marriage Act and please kindly quash and set aside the impugned orders dated 14-02-2023, 21-10-2024 & 27-06-2018 {(A-1, A-2 & A-2(a)} respectively. The Hon’ble Tribunal may, further, kindly be pleased to direct the Respondents to endorse/include/add the name of Smt. Arifa Ibrahim Sayyed as eligible spouse in Pension Pay Order (PPO) for
family pension after death of the applicant.
8.b Any other relief, this Hon’ble Tribunal may kindly deem fit to be granted.”
2. The facts of the case are that the applicant retired from service on 30th November, 2010. During life time of his first wife, the applicant married another woman, Ms. Arifa, under personal

law on 02nd January, 2011. The first wife of the applicant expired
on 29th March, 2017.
2.2 On 20th September, 2017, the applicant made an application for inclusion of the name of his second wife in the PPO for family pension purposes. However, the same was rejected vide communication dated 27th June, 2018. The reason given for such rejection was that the relationship with his second wife, Smt. Arifa, could not be recognized as a valid marriage as it had been contracted during the lifetime of the first wife, and no permission under Rule 21 of Railway Services (Conduct) Rule 1966 had been
obtained.
2.3 Subsequently, the Family Court dissolved the second marriage of the applicant vide its order dated 30th November, 2022. Thereafter, the applicant made an application on 23rd January, 2023 seeking permission to marry his divorced second wife. The same was rejected vide order dated 14th February, 2023, wherein it was mentioned that the competent authority had commented that there is no provision in the Railway Rules to grant permission to marry

a divorced illegal wife, especially when the Railway employee has been punished for the same. Thereafter, the applicant and his divorced wife again remarried under the Special Marriage Act,
1955 on 28th April, 2023.
