ORDER Per : Hon’ble Mr Justice Rameshwar Vyas Being aggrieved by communication dated 13.04.2016 (Annex. A/1) whereby the applicant was not found eligible for promotion to the post of Post Graduate Teacher (PGT) Hindi through Limited Departmental Examination (LDE), the applicant has preferred this OA praying to quash above order and provide him promotion to the post of PGT (Hindi) through LDE 2012-13 & 2013-14.

2. The facts necessary to adjudicate this OA are as under:- 2.1 The respondents vide Notification dated 15.07.2014 (Annex. A/4) invited online applications from eligible candidates to fill up the vacancies of various teaching and non-teaching posts through LDE inter-alia for the post of PGT (Hindi) for the year 2012-13 and 2013-14. As per para 2 of Notification, the feeder posts, promotional posts, educational qualification and eligibility criteria for various posts shall be as per Recruitment Rules [hereinafter referred to as RRs] in vogue for the year vacancies are to be filled up. As per RRs in case of recruitment by promotion through LDE from amongst eligible Trained Graduate Teachers [TGT] three years’ regular service as TGT in KVS with Master’s Degree in that subject/combination of subjects is required. Perusal of RRs reveals that for the promotional post of PGT (Hindi) feeder post is TGT (Hindi) or TGT Sanskrit having post graduation in the same subject. But for PGT (Sanskrit), additional qualification of post graduation in Hindi is essential.

2.2 As per admitted facts of the case, the applicant did his graduation in Sociology, Sanskrit and English Literature and acquired the post graduation degree of MA in Sanskrit also. Being posted as TGT (Sanskrit), the applicant applied for the post of PGT (Hindi). In the application form against the ‘Qualification Details he detailed his qualification as under :

Based upon the above information furnished by the applicant, he was allowed to appear in the examination. When the applicant did not get promotion after declaration of result, he obtained some information under RTI and made a representation dated 05.07.2016 (Annex. A/13) wherein he mentioned that his name is mentioned at serial No. 104 in the select main panel (Unreserved) for the post of PGT through LDE for the year 2013- 14. All the selected candidates have been posted by KVS vide letter dated 09.05.2016 but his name has disappeared from the above mentioned letter.

2.3 Being aggrieved by not getting promotion to the post of PGT (Hindi), the applicant has preferred this OÄ seeking promotion to the post of PGT (Hindi) on the ground that he is having the same qualification as the qualification of persons who have been promoted against LDE vacancies for PGT (Hindi) which is violation of the provisions of the Constitution, Rules and guidelines issued by the KVS.
