ORDER (ORAL)

The present OA has been filed by the applicant seeking the following relief:-

“8.1. To quash and set aside the findings of DME culminate into impugned order/letter dated 11.02.2025 (DME) whereby the applicant declared UNFIT and findings of RME which culminate into 23.04.2025 issued by the respondents, whereby the candidature of the applicant for the post of Constable (Executive) in Delhi Police on compassionate grounds has been cancelled on the ground of alleged medical unfitness and Direct the respondents to constitute a fresh and independent Medical Board preferably comprising specialists (including an Ophthalmologist and Dermatologist), in a reputed Government hospital such as AIIMS/ Safdarjung/RML, for re-examination of the applicant , and to assess his functional fitness in a fair and transparent manner and further to appoint the applicant to the post of Constable (Executive) in Delhi Police on compassionate grounds, within all consequential benefits including Seniority and Promotion and Pay and Allowances.

Or/ and Any other relief which this Hon’ble Court deems fit and proper may also be awarded to the applicant”

2. Learned counsel for the applicant states that the applicant’s father Late Sh. Suresh Kumar who was Constable (Executive) in Delhi Police, unfortunately expired while in service on 20.12.2026. The present applicant applied for appointment on compassionate grounds. The Screening Committee in its meeting dated 05.09.2024 declared the applicant fit for appointment subject to fulfillment of other formalities. The applicant was sent for medical examination. The first medical examination i.e. Detailed Medical Examination (DME) was conducted on 10.01.2025, the said medical examination found three defects namely, tattoo on right forearm, hesitation cut mark and defective distant vision. As per the established procedure, the applicant applied for Review Medical Examination (RME) which was conducted on 23.04.2025 and the review medical examination found two defects, i.e. tattoo on right forearm and defective distant vision.

3. Learned counsel for the applicant states that the applicant got himself examined in the Dr. R.P. Centre for Ophthalmic Sciences, AIIMS, New Delhi and PGIMER Advanced Eye Centre, Chandigarh on

15.07.2025, wherein it was found that the applicant is having perfect vision (6/6). In view of this, learned counsel for the applicant presses for an independent medical examination of the applicant. As regards to the tattoo on the right forearm, learned counsel for the applicant states that Hon’ble Delhi Court vide its order dated 20.01.2025, in WP (C) No.12891/2024 has passed the following order:-

“3. There is no justification whatsoever for the petitioner challenging such an innocuous order. There can be no reservation whatsoever with the candidate concerned being examined by a Dermatologist, who would assess whether the candidate does or does not possess a tattoo on the right forearm.
