Government authorities are directed to decide representations for grade pay upgrades by issuing reasoned speaking orders, specifically considering binding judicial precedents and the principle of parity with similarly placed employees.

O R D E R (ORAL).

1. The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act, 1985,for the following reliefs: -

(a) as An order issuing direction upon the respondents to grant Grade Pay of Rs.5,400/- (PB-2) to the Applicants herein on completion of 4 years in the pay- scale of Rs.7,500-12,000/- (Pre-revised) 06.09.2010 of Hon'ble High Court of Madras, as upheld per Judgment dated by Hon'ble Supreme Court vide its order dated 10.10.2017 and that dated 23.08.2018 and as decided by Board vide it's letter dated 22.10.2019 and 27.07.2020 and Estt. Order No. 286/19, dated 06.12.2019 and subsequent similar Establishment Order issued in implementation thereof for extension of benefit covered under the judgment dated 06.09.2010 with all consequential benefits including arrears of pay;

(b) An order directing the respondents to grant Grade Pay of Rs.5,400/- (PB-2) in the pay-scale of Rs.7,500-12,000/-(Pre-revised) to the Applicant on completion of 4 years of service in the Grade Pay of Rs,4,800/- in PB-2, i.e. w.e.f. from the date as mentioned in para 4(f) hereinabove.

(c) An order quashing and setting aside Competent Authority's Office Order dated 16.01.2026.

(d) An order directing the respondent authorities to provide production of relevant documents.

(e) Any other order or further order/orders as this Hon'ble Tribunal may deem fit and proper.

2. Learned Counsel for both the sides are present and heard.

3. Learned Counsel for the respondents Mr. B.P. Banerjee and Ms E. Sinha file their memo of appearance, which are taken on record.

4. The submissions made by Learned Counsel for the applicant are summarized below:-

4.1 The applicant is a Superintendent in CGST Department in the Grade pay of Rs. 4800. He has completed 04 years of service in the same grade and is now entitled to the Grade pay of Rs. 5,400 as per the orders of the Hon’ble High Court of Madras in WP No. 13225 of 2010 which was upheld by the Hon’ble Supreme Court in Civil Appeal no. 8883 of 2011 vide its order dated 10/10/2017.

4.2 Subsequently, a no. of similarly placed employees have been granted the same relief on the basis of orders passed by this Tribunal as well as in the coordinate Benches.

4.3 The applicant has made a representation dated 19/08/2025 which has been rejected by the authority on the ground that, “Specific orders of Hon’ble CAT on an O.A. needs to be there for allowing such benefits to the said officers and is also required for implementation of such an order of the Hon’ble CAT.”

We deem it fit to dispose of the O.A. at this stage by directing the respondents to specifically consider the representation of the applicant dated 19/08/2025 (Annexure-A/8) of the O.A. and issue a reasoned speaking order within a period of 90 days specifically in the light of the judgments of the Hon’ble High Court at Madras upheld by the Hon’ble Supreme Court as mentioned above.

6. With these directions, the O.A. is disposed of. There shall be no order as to costs.
