1.1 Present OA has been filed by the applicant under Section 19 of the Administrative Tribunals Act 1985, seeking the following reliefs:-

i) That the Hon'ble Tribunal may graciously be pleased to pass an order of quashing the impugned transfer order dated 03. 08.2023 (Annex.A/1) qua the applicant and order dated 06.05.2024 (Annex.A/2) declaring to the effect that the same are illegal, arbitrary and discriminatory and consequently, pass an order directing the respondents to modify the place of posting of the applicant and the applicant may be consider to be posted at Delhi or nearby station as per his choice on spouse ground with all consequential benefits.

(ii) That the Hon'ble Tribunal may graciously be please to pass an order of quashing the impugned para 3(1) of Par-1-A of the KVS transfer Guidelines, 2023 only to the limited extent of putting 3 years conditions for considering spouse ground transfer application and consequently, pass an order directing the respondents to consider the request of KVS teachers on spouse grounds as per Govt. of India instructions on the subject.
