1. The present Original Application has been filed by the applicant on 01.09.2016 under Section 19 of the Administrative Tribunals Act, 1985 seeking quashing of the order dated 02.05.2016 whereby his candidature has been cancelled and he has been debarred for life from appearing in RRC/RRB examinations. The reliefs prayed for by the applicant are as under:–
2. The brief facts of the case are that the applicant had applied pursuant to Employment Notice No. 01/2013 issued by the Railway Recruitment Cell for Group ‘D’ posts. He appeared in the written examination and qualified the same and thereafter qualified the Physical Efficiency Test. It is not in dispute that the applicant participated in all stages of the selection process. The controversy arose when a show cause notice dated 27.01.2016 was issued alleging mismatch of thumb impression. The applicant submitted his reply denying the allegation and requested for proper verification. However, the respondents, without undertaking any further verification, passed the impugned order dated 02.05.2016 cancelling his candidature and debarring him for life.
