O R D E R SUDHI RANJAN MISHRA, MEMBER (J):

1.The applicant at present working as Chief Reservation Supervisor (CRS) at Cuttack under SMR, Cuttack has filed this original application challenging the illegal order dated 05.11.2024 (A/6) wherein he has been transferred from Cuttack to Bhadrak (BHC) without any valid reason. He has prayed for following reliefs:

i) To allow the Original Application.

ii) To quash the order No.P/COMML/158/2024 dated 5th November, 2024 under Annexure-A/6.

iii) To pass any further order/orders as deem fit and proper in the facts and circumstances of the case. The brief facts of the case as inter alia averred by the applicant

2. in the OA is that while working as Commercial Superintendent (ECRC), Cuttack had challenged the order dated 20.11.2023 transferring/posting him to Jagatsinghpur under CCI/PRDP earlier had approached this Tribunal in OA No. 702/2023 on the grounds that there was no such post of Commercial Superintendent was available at Jaghatsinghpur and there is a Non-rail Head Counter/Satellite Counter at that place. Further, the person on whose place he has been transferred is Commercial-cum-Reservation Clerk, which is a base level post in Commercial D
