ORDER

1. Being aggrieved with the decision of the respondents to withheld of Gratuity, Regularisation of pension and other retiral dues applicant has filed the present OA, under Section 19 of the Administrative Tribunal Act, 1985, seeking following reliefs: -

“Para 8 (A) Time-Bound Release (Within 15 days):

Direct the Respondents to release the entire withheld amount comprising Gratuity, Regularisation of Pension, and interest on delayed Pension for first 6 months along with applicable interest on the delayed GPF payment, within a strict timeline of 15 days.

Relying on the ratio of D.D.Tewar (Dead) Thr. LRs vs. Uttar Haryan Bijli Vitran Nigam Ltd. & Ors. Citation: (2014) 8 SCC 894 strictly direct that if the said total amount is not released within the stipulated 15 days, the interest rate shall stand automatically enhanced to 18 % p.a. (Compoundable) for the entire period of delay.

(B)Continuing Mandamus:

Direct that the present Original application shall not be disposed of merely on the basis of an assurance from the respondents, but shall be kept pending (Continuing Mandamus) until the actual credit of the entire funds (Principal + Interest) is reflected in the applicant’s bank account, so that Respondents should not be able to misuse and abuse the law to buy time and further continue harassment in the plea of another limitation period.

(C)Any other Relief:

Pass any other order or direction which the Hon’ble Tribunal may deem fit and proper in the facts and circumstances of the case.”

2. Brief facts of the case as stated by the applicant are as under: -

2.1 The applicant was appointed as a Chemical Examiner Gr.II (Group –

B, Non Gazzetted) on 15.11.1996 and was posted at Custom House Laboratory, Mumbai under the Central Revenue Control Laboratory, New Deli, Ministry of Finance, Department of Revenue.

Subsequently, she was promoted to Chemical Assistant Grade –I in the year 1999. Thereafter, clearing UPSC interview, she was further appointed as Chemical Examiner Gr.II (Group – A Gazetted) on

11.08.2001.

2.2 The applicant thereafter, while working at Government Opum, Alkaloid works in Ghazipur as Group proper channel on 09.01.2024 with a three months notice period from 09.01.2024 to 09.04.2024 and requested that she may be allowed for voluntarily retirement from service. A Gazetted Officer had submitted an application for voluntary retirement to the Chairman, Central Board of Indirect Tax and Customs, New Delhi through

2.3 The said application/Notice dated 09.01.2024 of the applicant for her voluntary retirement has been approved by the Competent Authority and in this regard, the CBIC vide notification dated 09.04.2024 informed the applicant that the President is pleased to accept the notice of the applicant for Voluntary Retirement under Rule 43 of CCS (Pension) Rules, 2021 w.e.f 12.04.2024 (A/N).

2.4 Pursuant to the said notification dated 09.04.2024 issued by the CBIC, the applicant herein was relieved from her duties Government Opum, Alkaloid works in Ghazipur on 12.04.2024.

2.5 It is stated that the applicant was served with charge memorandum No. F. No. G14011/37/2023-AdV/3928 dated 08
