ORDER

1. The SWP No. 1619/2012 was transferred from the Hon’ble High Court of Jammu & Kashmir at Jammu and was registered as T.A No.293/2025 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court seeking following relief: -

a) “ Writ of Certiorari so as to set aside and quash the Advertisement Notice No. DDJ/ACA/12/1506-26 dated 28-06-2012 issued by respondent No.3 the extent it refers the post of COPA ITI Poonch held by the petitioner for fresh selection on academic arrangement basis and allow the petitioner to continue against the post held by him till the regular selection is made or till he acquires his eligibility for regularization in terms of the Jammu and Kashmir Civil Services (Special Provisions) Act 2010. Further quash and set aside section 3 (b) of the Jammu and Kashmir Civil Services (Special Provisions) Act 2010 to the extent that it excludes the petitioner and the persons appointed on academic arrangement for fixed term from the benefit of regularization and declaring it as violative of article 14 of the Constitution of India.
