ORDER
Per: Justice M. G. Sewlikar, Member (J) By this application, the applicant is challenging the charge sheet dated 10th July, 2012 (Annexure- A/1) and directions to respondents to release the applicant’s pensionary benefits.
2. Facts in brief can be stated thus:
2.1 The applicant was appointed as Provident Fund Inspector Grade- I on 10 December, 1982. He was promoted to the post of Assistant Provident Fund Commissioner in the year 1988 and subsequently to the post of Regional Provident Fund Commissioner Grade- II. In the year 2005, he was promoted as Regional Provident Fund Commissioner Grade- I. The applicant was transferred as Regional Provident Fund Commissioner Grade-I, Bandra (East), Mumbai. On 12th December, 2007, he was transferred to Kolkata. He made representation against this transfer. However, the applicant was placed under suspension vide order dated 04t June, 2008, in exercise of the powers conferred by rule 6(1)(ii) of the Employees Provident Fund Staff (CCA rule 1981) (Annexure- A/2).
2.2 The applicant came to be superannuated on 31st May, 2009. He has been granted provisional pension but other pensionary benefits have not been released.
