BY JUSTICE AKHIL KUMAR SRIVASTAVA, JM:-
1.The applicant by way of filing this Original Application is challenging the inaction of respondents in not considering the applicant’s application for compassionate appointment.
2. The facts of the case is that the father of applicant, while working as Fitter, S.E.C.R., Bhilai, died on 20.07.1980 during his service, then 2 applicant's mother late B. Rajkumari got compassionate appointment in S.E.C.R. (W) B.M.Y. as Khalasi. As applicant's father was not having their own child then, when applicant was 7 years of age, he was adopted by Late B. Rajkumari in front of village Panchayat and other family members as per the customs. (A copy of Adoption Deed 20.01.2000 is annexed herewith as ANNEXURE A-1). The applicant has been living with Late B. Rajkumari during her life and she died on 21.08.2008. The applicant was living with her mother in the Railway Quarter and after her death applicant processed for vacating the quarter and other related amenities by himself only. The applicant is having Identity Cards viz Adhaar Card, Voter Id Card, School Certificates and other in which RAJ UL NAM Father's name is B. Saibaba and in mother's name B. Rajku
