1. Being aggrieved by the order F.No. II/34-04/CCO/2017 dated 25.04.2017 whereby the applicant were placed below their junior in the Seniority List prepared for the post of Lower Division Clerk of Central Excise, Customs and Service Tax in the combined cadre of Gujarat Zone as on 01.01.2017, has filed the present OA, under Section 19 of the Administrative Tribunal Act, 1985, seeking following reliefs: -

“A) Quashing and setting aside the impugned seniority list dated 25.04.2017 issued by the respondent No. 3 (Annexure –A/1)

B) Directing the respondents to prepare a new seniority list of Lower Division Clerk showing the applicants as seniors to the private respondents No.4 to 10 herein; and

C) Passing any other appropriate order.”

2. Brief facts of the case are as under: -

2.1 The applicants submit that the applicants No.1 to 6 came to be appointed by the respondent Department as Sepoy during the period between 1993 and 1997. The applicant No.7 had joined the Department in the year 2005 on the post of Sepoy on compassionate ground. The private respondents herein, respondents No.4 to 10 had joined the Department in the year 2008
