O R D E R

Per : Kumar Rajesh Chandra, Administrative Member

1.The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act, 1985 praying for the following relief:

“(8.A) That the respondent be directed to pay the applicant salary/ pay pension revised in view of letter RBE No. 40/12 New Delhi dated 23.03.2012 and grant him two increment i.e. 01.01.2006 and on 01.07.2006 and accordingly revised the pay/ pension.

(8.B) That the respondents be directed to pay the revised arrears with penal interest @18% per annum.

(8.C) Any other relief or reliefs including cost of the proceeding be allowed in favour of the applicant.”

2. For the sake of clarity, facts in the case as stated by the applicants in the OA, are discussed and delineated herein under:-

The applicant retired from service as a Senior Sectional Engineer (SSE) under the Respondent Railways.

The applicant was initially appointed in the Railways on 12.02.1974 and was promoted to the post of Senior Sectional Engineer (Tele) on 23.12.2005 under the East Central Railway, Danapur Division. At the time of promotion, the applicant’s basic pay was fixed at Rs. 8350/- in the pay scale of Rs. 7450–225–11500, where
