In the present Original Application (OA) filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following reliefs:–

“1. To call for records of the case and quash/set aside the impugned order dt. 9.11.2021 and direct the respondents to grant Compassionate Allowance to applicant w.e.f. 26.9.2005.

2. To award cost in favor of the applicant and pass any other order or orders, which this Hon’ble Tribunal may deem just & equitable in the facts & circumstances of the case.”

2. Brief facts of the case are as under:-

2.1 The applicant joined the services of the respondents on 27.06.1981. He was dismissed from service vide order dated 13.11.2000 on the ground of unauthorized absence. However, the said order was set aside by the Appellate Authority vide order dated 23.07.2002, and the applicant was reinstated in service. He accordingly rejoined duty on 12.08.2002 and was granted full pay and allowances for the intervening period from 14.11.2000 to 11.08.2002.
