JUSTICE NARENDRA KUMAR JOHARI, MEMBER (J) :-
1.The present OA has been filed for the following relief(s) :-
“8.1 That your Lordships may graciously be pleased to quash and set aside the order dated 14.11.2025 as contained in Annexure A/1, issued for the Respondent No.5 as highly illegal, punitive, tainted with malice.
8.2 That your Lordships may graciously be pleased to quash and set aside the order dated 18.11.2025 as contained in Annexure A/2 issued by the Respondent No.5 whereby applicant has been directed to release/spared illegally.
8.3 That your Lordships may graciously be pleased to direct/command the respondents to allow the applicant to continue at Sahibganj (Malda Division) without disturbance any applicant. to the applicant.
8.4 That your Lordships may graciously be pleased to direct/command the Respondents to grant all consequential benefit in favor of applicant.
8.5 Any other relief or reliefs including the cost of the proceeding may be allowed in favor of the Applicant.”
2. The brief facts of the case is that the petitioner is a Railway Employee. He is working in Group ‘C’ on the post of Sr. Section Engineer (Loco), Eastern Railway, Sahibganj which comes under Malda
