ORDER

Hon'ble Dr. Sumeet Jerath, Member (A) :

1.The instant OA has been filed by the applicant under section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs :-

“(a) To declare the action of respondents in promoting the applicant as Assistant Director (OL) from 23.05.2013 as illegal and direct the respondents to promote the applicant to the post of Assistant Director (OL) from 23.05.2013 with all consequential benefits including arrears of pay.

(b) To direct the respondents to hold yearwise DPC for promotion to the post of Assistant Director (OL) and considered the applicant claim against the available vacancies from due date.

(c) To allow the OA with cost.

(d) To pass such other and further orders which their lordships of this Hon'ble Tribunal deem fit and proper in the existing facts and circumstances of the case.”

2. The factual matrix of the case as per the counsel for the applicant is that the applicant had been working as a Senior Hindi Translator in the Income Tax Department and was promoted to the said post on 28.09.2001.
