1.Present Original Application has been filed under Section 19 of the Administrative Tribunals Act, 1985, seeking the following relief:

“(1) Issue order or direction to quash the order of respondent no. 02 dated 19.10.2012 and order of respondent no.3, dated 22.10.2012.

(2) Issue order or direction to reinstate in service on the Post of EGMP, Pathkhauli, District Azamgarh.

(3) Issue any other order or direction, which this Hon’ble Court may deem fit and proper in the facts and MADHU signed by circumstances of the case.”

2. Brief facts of this case are that one post of EDMP (Extra Departmental Mail Peon) Pathkhauli, Azamgarh fell vacant and was reserved for Scheduled Caste Candidate to be filled on merit on the basis of percentage of marks in the High School Examination. Against the aforesaid post, the applicant was appointed on 28.10.1999. Aggrieved with this, respondent no.5 filed an Original Application No.119 of 2000 before this Bench seeking the direction to cancel the appointment of the applicant and for consideration of the application of respondent no.5 for the post of EDMP.
