1. The SWP/WPC/1665/2019 was transferred from the Hon’ble High Court of Jammu & Kashmir at Jammu and was registered as T.A No.487/2020 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court seeking following relief: -

“In the Premises’’

It is therefore most respectfully prayed that keeping in view the submission made here in above and those to be urged at the time of hearing the Hon’ble Court be pleased to issue a writ of:-

A. CERTIORARI/QUO-WARRANTO; So as to quash selection and appointment oder impugned bearing No. DHSJ/PS- 8/Sel-Lab/15-16/2610-M dated 28.05.2016 where by the private respondent is illegally and arbitrarily selected and appointed to the post of Junior Lab Technician (Health Department) District Cadre Kishtwar Pursuant to Notification No.06 of 2013 , Item No.517, as the private respondent did not possess the qualification required for the said post under the Recruitment Rules.

B. MANDAMUS :So as to command and direct the respondent No.2 to declare the result of the petitioner and accordingly recommend him for selection against the post of Junior Lab Technician ( Health Department)
