1. The applicant has filed the present Original Application under Section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs: -

a) Allow the Instant Original Application.

c) Direct the respondents to prepare waiting list for the post of Election Assistant (Junior Scale) District Cadre, Udhampur,on the same analogy as adopted by the respondents in case of post of Election Assistant, District Cadre, Bandipora, advertised vide same notification i.e, Notification No. 01 of 2011 dated 31.01.2011, in the backdrop of two vacancies created due to non-joining of the appointed candidates.

d) Direct the respondents more specifically respondent no. 1 & 2 to appoint the applicant, being next in merit, to the post of Election Assistant (Junior Scale) District Cadre, Udhampur, advertised vide Notification No. 01 of 2011 dated 31.01.2011, in the backdrop of two vacancies created due to non-joining of the appointed candidates.

e) Prohibit the respondents to respondents to re-advertise the post of Election Assistant (Junior Scale) District Cadre, Udhampur advertised vide Notification No. 01 of 2011 dated 31.01.2011.
