ORDER

By Hon’ble Mr. Mohan Pyare, Member (A)

1.Present Original Application has been filed under Section 19 of the Administrative Tribunals Act, 1985, seeking the following relief:

“a) issue a writ, order or direction in the nature of certiorari quashing the punishment order dated 26.08.2009 and the appellate order dated 09.10.2009 (Annexure A-1 and A-2) with all consequential benefits within a stipulated period of time whatever is fixed by this Hon’ble Tribunal.

b) issue such other suitable order or direction as might by found just and proper in the facts and circumstances of the case.

c) Award the costs to this Original Application in favour of the applicant, throughout.”

2. Brief facts of this case are that the applicant was initially appointed as Call Man a Group ‘D’ post on compassionate appointment and was subsequently promoted as Helper Khalasi in the pay scale of 2550-3200. While he was working as Call Man, he was served with a major memorandum for the alleged misconduct for using abusive language for Chief Crew Controller in an inebriated state on 12.04.2009 and leaving the duties without any application on the same day at about 14:00 hours.
