ORDER

Per: RAMESH SINGH THAKUR, MEMBER (J):

1. The present Original Application filed under Section 19 of the Administrative Tribunals Act, 1985 is directed against order dated 29.04.2024 (Annexure A-1) and 28.05.2025 (Annexure A-2) vide which the parent department has terminated the Lien of the applicant w.e.f. 17.04.2025. The applicant has prayed for reliefs as under:

“i. Quash order dated 29.04.2024 (Annexure A-1) and dated 28.05.2025 (Annexure A-2) vide which the parent department has terminated the Lien of applicant w.e.f 17.04.2025, without any notice or opportunity, without taking note of the fact that the applicant has not yet been confirmed in the new department and Fundamental Rules (Annexure A-10) rules mandates that at no point of time a government employee should be left without lien against one post and termination of lien can only take place once employee is confirmed as has been settled by Hon'ble Supreme 2 (0.A.No0.060/670/2025) Court in 'L.R.Patil vs The Gulbarga University Gulbarga’ vide judgment dated 04.09.2023, in 'State of Rajasthan and Another Vs.
