ORDER(ORAL)

Hon’ble Mr. R. N. Singh, Member (J) Pleadings in the matter are complete. With the consent of the learned counsels for the parties, the matter has been taken up for consideration and final disposal.

2. We have heard the learned counsels for the parties and with their assistance, we have also perused the pleadings available on record.

3. In the present Original Application, filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following relief(s):-

“8.1. to allow the present Application;

8.2. to quash the impugned Orders dated 04.09.2024 [Annexures : A-1] as well as ‘dismissal from service’ passed by the Disciplinary Authority order Dated 18.01.2023 [Annexure:

A-2] as being bad in law.

8.3. To quash the charge memo Dated 06.07.2021 [Annexure:

A-3] as the same is issued by incompetent authority.

8.3. to grant all consequential benefits including to treat the Period from ‘dismissal from service’ onwards as days spent on duty, pay, allowances and seniority to the Applicant;

8.4. to allow exemplary costs of the application; and

8.5. to issue any such and further order/directions this Hon'ble Tribunal deems fit and proper in the facts and circumstances of the case.”

4. The claim of the applicant has been contested by the respondents. They have filed counter reply seeking dismissal of the OA. The applicant has filed rejoinder reiterating his claim and the grounds pleaded in support thereof. With the leave of the Court, on behalf of the applicant, a written submission along with judgments has been filed.

It is undisputed that a disciplinary proceeding was initiated by the respondents against the applicant while he was working as ASP (HQ) Jhansi Division vide memorandum dated 06.07.2021 (Annexure A-3) for allegations that while working as ASP West Etah, w.e.f., 16.05.2012 to 19.06.2015, the applicant had made an irregular engagement of one Sh. Sandeep Rajput to the post of GDSMD under Etah Division and with further allegations that while working as such, the applicant had made an irregular engagement of one Sh. Pradeep Rajput on the post of GDSMD under Etah Division, AKANSHA

The memorandum dated 06.07.2021 and such engagements were made on the basis of fake, false AKANSHA has been approved and issued by the Director Postal Services, Agra Region, Agra. Pursuant to such memorandum, the Director Postal Services passed order for appointment of Inquiry Officer and Presenting Officer and the Inquiry Officer reported the allegations made against the applicant as proved.

Based on such inquiry, the disciplinary authority vide order dated 18.01.2023 (Annexure A-2) inflicted the penalty of dismissal from service. Aggrieved by the same, the appli
